Kansas: no state license covers chimney work. Here's what that means.

Kansas is a double-weak state with one sharp exception. It has no state contractor board, no statute requiring a seller condition form, and no statewide residential CO statute found. Yet it registers roofers with the Attorney General, with a $500,000 insurance floor, while leaving chimneys, which sit right next to the roof, entirely unregulated.

On the master-finding axis, Kansas BREAKS the clean inverse. The correlation predicts a no-license state should hand you mandatory disclosure, but Kansas mandates only radon and special-assessment notices. The real leverage is the KCPA:

• up to $10,000 per violation;
• actual damages or that penalty, whichever is greater;
• a built-in 3-day cancel for door-to-door sales.

The messages: nothing to look up statewide, and no condition form owed to you by law. Get your own inspection and lean on the KCPA.

No statewide license covers chimney work in Kansas, and there is no state contractor board for general construction. Kansas has no state general-contractor, residential-builder, or home-improvement license. Licensing, testing and enforcement happen at the city and county level, and chimney masonry, relining and sweeping fall outside any state credential. The big local regimes:

• Wichita / Sedgwick County: contractors are licensed through the Metropolitan Area Building & Construction Dept. (MABCD). MABCD tells homeowners to verify roofers are "registered with the State of Kansas and licensed with MABCD."
• Johnson County: runs a county contractor-licensing program used by participating cities.
• Wyandotte County / Kansas City, KS: reported to require only a business license.

The one statewide exception is roofing. Under the Kansas Roofing Contractor Registration Act (K.S.A. 50-6,121 to 50-6,138), no one may act as a roofing contractor without an Attorney General registration certificate (K.S.A. 50-6,123). The application must include:

• a certificate of liability insurance of not less than $500,000 (K.S.A. 50-6,125);
• proof of workers'-comp coverage or an exemption;
• a Kansas tax clearance.

The AG sets the annual fee by rule, capped at $500 (K.S.A. 50-6,128). A chimney is not roofing, so chimney work is neither AG-registered nor state-licensed. "Licensed and bonded" here means a county or city credential, valid only in that jurisdiction.

Statewide, there is nothing to verify for chimney work: no exam, no registry, no bond. County contractor exams (MABCD, Johnson County), where they apply, test general building and permit knowledge, not flue diagnosis or masonry skill. The AG roofing registry is verification-rich but does not touch chimneys. Individual certifications (NCSG CCP/CCR; CSIA CCS, C-DET) and an independent audit fill a total vacuum.

Kansas has NO statute requiring a general seller property-condition disclosure form. Sellers are held to common-law rules against concealing or misrepresenting known material defects. Two narrow statutory seller duties do exist, and neither touches the chimney:

• Special assessments (K.S.A. 12-6a20): the seller must disclose that the property is subject to a special assessment or fee and get the buyer's written acknowledgment.
• Radon (K.S.A. 58-3078a): residential sale contracts must carry the statutory radon notice, and sellers must disclose known elevated radon test results.

In practice most sales use the Kansas Association of REALTORS® Seller's Property Condition Disclosure Statement, a voluntary industry form. It reportedly names the fireplace and chimney and asks when they were last cleaned. NOT YET CONFIRMED That form's wording was NOT re-verified in this pass. Do not quote it until confirmed. Using it is contractual, not statutory. No inspection is mandated at transfer; NFPA 211 Level 2 stays a NATIONAL STANDARD.

The Kansas Consumer Protection Act (KCPA), K.S.A. 50-623 et seq., bars deceptive and unconscionable acts in consumer transactions. It works on three levels:

• Public enforcement: the AG's Consumer Protection Division and county or district attorneys can seek civil penalties of up to $10,000 per violation (K.S.A. 50-636(a)). A continuing practice counts as a separate violation each day, and willful violation of a court order costs up to $20,000.
• Private right of action: a consumer may recover actual damages or the § 50-636(a) civil penalty, whichever is greater (K.S.A. 50-634(b)), plus attorney's fees as the Act provides. There are no automatic treble damages.
• Door-to-door cancellation (K.S.A. 50-640): a consumer may cancel a door-to-door sale of $25 or more "until midnight of the third business day after the day on which the consumer signs an agreement." Caveat: the section excludes maintenance or repair visits the buyer requested, unless additional goods or services are sold, and emergency sales with a signed waiver.

The Kansas AG's Consumer Protection Division pursues home-repair and door-to-door contractors. The door-knock "we noticed your chimney" pitch is a textbook K.S.A. 50-640 + KCPA scenario, while a sweep the homeowner requested is excluded from § 50-640. No KS chimney-sweep-specific enforcement action has been confirmed. Use patterns, not names.

Kansas has no statewide building code for general residential construction. Each city or county adopts its own, usually an IRC/IBC edition with local amendments. Wichita/Sedgwick (MABCD), Johnson County jurisdictions, and Kansas City, KS each maintain their own adoptions. Unincorporated rural counties may have no code and no permit process at all. Where a building department exists, chimney relines, rebuilds, crowns and solid-fuel appliance installs are generally permit work; routine sweeps and like-for-like caps generally are not. Kansas appears to have NO statewide residential carbon-monoxide-alarm statute, meaning no state mandate for rentals, new construction or sale. CO requirements are LOCAL, through adopted building and fire codes. A narrow administrative CO-detector rule for lodging establishments with fuel-fired equipment, wood-burning fireplaces or attached garages has been reported (K.A.R. 4-27-8).
